Terms of Sale
These Terms of Sale govern your purchase of NewEvos (the “Game”) through this website. Your order is placed with Paddle.com Market Limited (“Paddle”), our authorized reseller and the Merchant of Record for this purchase — Paddle appears on your card/bank statement and invoice, handles payment collection, and calculates/remits any applicable sales tax, VAT, or GST for your location. The Game itself is developed and supplied by Matthew Foley, a sole proprietor (collectively “we,” “us,” the “Supplier”). By completing a purchase you agree to these terms, the End-User License Agreement, the Refund Policy, Privacy Policy, and Paddle's own Buyer Terms.
The product
- NewEvos is a digital download for Windows 10/11 (64-bit), sold as a one-time purchase at the price shown at checkout (final pricing to be announced). There is no subscription and no recurring charge.
- The Game includes single-player campaign, drop-in co-op, and online competitive modes, delivered “as is.” Features, content, and system requirements may change in updates.
Payment
- Payments are processed by Paddle, our Merchant of Record. We do not receive or store your full card or bank details — Paddle handles that.
- Your order is confirmed only when Paddle reports the transaction as completed for the listed price (before tax).
- Listed prices are in U.S. dollars; Paddle's checkout displays and charges your local currency and any applicable sales tax/VAT/GST for your location automatically — you are not separately responsible for remitting tax on this purchase, Paddle handles that as Merchant of Record.
Delivery
- After a successful payment you receive access to a time-limited, secure download link for the installer. The link is tied to your purchase and may expire; contact support if you need it re-issued.
- Delivery is electronic only. No physical goods are shipped.
Eligibility
You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract, to purchase. By buying you confirm the payment method is yours or that you are authorized to use it.
Governing law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California.
End-User License Agreement
This End-User License Agreement (“EULA”) is a contract between you and the Seller for the use of NewEvos. By installing or using the Game you accept this EULA.
License granted
The Seller grants you a personal, non-exclusive, non-transferable, revocable license to install and play one copy of NewEvos on devices you own or control, for your own private, non-commercial entertainment.
You may not
- Copy, resell, rent, lease, sublicense, or redistribute the Game or its installer;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, except where that restriction is prohibited by law;
- Modify, adapt, or create derivative works from the Game's files or assets;
- Remove or alter any proprietary notices, or circumvent the download/license protections;
- Use the Game for any unlawful purpose or in violation of these terms.
Ownership
The Game is licensed, not sold. All title, ownership, and intellectual-property rights in and to NewEvos — including its code, art, audio, and the “NewEvos” name and logo — remain with Matthew Foley and his licensors. This EULA grants you no rights to any trademarks or branding.
Third-party rights
NewEvos may incorporate engines, libraries, or assets owned by third parties and used under their respective licenses. Those rights remain with their owners. Nothing here transfers ownership of any third-party material to you.
Termination
This license ends automatically if you breach it. On termination you must stop using and delete all copies of the Game. Sections on ownership, disclaimers, and liability survive termination.
Disclaimer of warranties
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Game will be uninterrupted, error-free, or compatible with every system configuration. Some jurisdictions do not allow the exclusion of implied warranties, so part of this may not apply to you.
Limitation of liability
To the maximum extent permitted by law, the Seller will not be liable for any indirect, incidental, special, or consequential damages, or for lost data or profits, arising from the Game. The Seller's total liability for any claim will not exceed the amount you actually paid for the Game. Nothing in this EULA limits liability that cannot be limited by law.
Refund Policy
NewEvos is a digital product delivered immediately after purchase. Because the installer can be downloaded and kept as soon as your payment clears, we treat sales differently from physical goods.
General policy
- All sales are final once the download link has been issued or used. By completing checkout you acknowledge that delivery begins immediately and you request access right away.
- If you have not yet accessed your download link, contact us and we will consider a refund on a case-by-case basis.
If something's wrong
If the Game won't install or run, email support first — most issues are SmartScreen prompts, missing prerequisites, or a corrupted download, and we can usually fix them fast. We'd much rather get you playing than process a refund.
Duplicate or unauthorized charges
For accidental double-purchases or a charge you didn't make, contact us with your Paddle order/transaction ID (starts txn_, shown on your receipt email) and we'll investigate promptly. Because Paddle is the Merchant of Record, refunds are issued by Paddle back to your original payment method.
Your statutory rights
This policy does not override any non-waivable refund or consumer-protection rights you have under the laws of your country or state. Where such rights apply, they continue to apply.

Privacy Policy
This policy explains what limited information we handle when you visit this site and buy NewEvos. We aim to collect as little as possible.
What we handle
- Payment information. Processed entirely by Paddle, our Merchant of Record. We never see or store your full card or bank details. Paddle shares with us only what's needed to confirm and fulfill the order (e.g. transaction ID, payment status, amount, and the email address used at checkout).
- Download access. After purchase we generate a short-lived, signed token so only paying customers can download the installer. The token expires and is not used to track you.
- Support email. If you email us, we keep your message and address to respond.
- Basic technical logs. Our host (Cloudflare) records standard request data such as IP address and browser type for security and to keep the site running.
- Epic Account Services data. If you sign in with your Epic Games account to use online, co-op, or cross-play features, our app requests access to your account ID, display name, language, country, linked-account display names, online status, and friends/blocked lists, solely to provide those features. See Epic's Privacy Policy.
What we don't do
- We do not sell or rent your personal information.
- We do not run third-party advertising or behavioral tracking on this site.
- The single-player campaign does not require an account; online, co-op, and competitive modes require signing in with Epic Account Services.
Service providers we rely on
- Paddle — payment processing and Merchant of Record (see Paddle's own privacy policy).
- Resend — delivery of your download-link email.
- Cloudflare — website hosting, content delivery, and download storage.
- Epic Online Services — account sign-in, online sessions, and cross-play. See Epic's Privacy Policy.
Data retention
We keep order and support records as long as needed for accounting, tax, and support purposes, then delete or anonymize them.
Your choices
You may ask us what information we hold about you, request a copy, or ask us to delete it, subject to records we must keep by law (such as tax records). Email matthew.foley01@yahoo.com.
Children
This site and the Game are not directed to children under 13, and we do not knowingly collect their information.
Changes
We may update this policy; the “Last updated” date at the top will change accordingly. Continued use after an update means you accept the revised policy.
